The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. Carroll is a native of Trinidad and a retired US Navy officer. As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Dear Attorney,
i would like to join a very good opportunity on EAD but have one concern shown below.
"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"
Your advice will help me alot and would be really appreciated!!!!

Hi,
My H1 was denied the last cycle. The denial decision was posted on Nov 24th. My application was in RFE state for quite some time, hence the delay. The question that I have is, as the denial came very late, will I be able to apply for an H1B this year. We generally file all our documents on 3.31, I am wondering if I would not be eligible this year because 3.31 is not 6 months from 11.24. There is an rule that I cannot apply if there has been a denial in the recent 6 months. Please let me know if that is the case. Will I be ineligible for this year (3.2010).
I am currently in my 4th year on a L1.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

A little out of the box thinking. There are some useful ideas here even if there are many practical questions on how the plan would work. For one, is a highest bidder system necessarily the best indicator of which employers are most deserving of securing visas. Should a school system desperate for math teachers lose out on securing a visa just because it has a much more limited budget than a major corporation? I'd suggest perhaps looking at a program like this running as a separate track in the immigration system rather than necessarily replacing what we have. Of course,...

My I-140 was denied / and we have applied for Motion to Reopen . in the meantime, i have my AP approved this 2011. can i switch employer.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?
