My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

Recently I registered in this website and I found is a great way to express our needs and keep informed about the immigration debate.
I see that PR and USVI are no listed in the state list. Here live a lot of H and L visa holders.
Recently my company lawyers told me that they summit my LC application using PERM.
What is the estimated time to get the Labor Certification?
Any idea of the GC process time in PR (I think that processing center is Vermont) ?

Hi -
I got my I-140 approved back in 2008 and last year my H1b was extended for another 3 years.
I am planning to change job now and once the new company transfers my H1b will it be extended for another 3 years or for the remaining duration of my current H1B.
Also what happens if my current employer revoke the I-140 after i change job?
Until when can i start the GC process with new company so that i don't go out of status and keep getting extensions until i get my GC?

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Brothers who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved what happens to my 485 application?
Wouldnt USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

My 485 is currently pending from current employer.Getting a new offer from the client for full time job. My labor certification wage is very high around 95k(no benefits) and the new offer is for 80k with benefits. Doing the math the new offer is lucrative. With Current employer paying $1100/month for insurance and with zero vacation time.
Is it recommended to use AC21 and take the new offer even though the salary is less than 15k from labor certification wage. The Job responsibilities are similar.

Well, the first questions are what are your other settings? What mode are you shooting in. What ISO and aperture are you shooting in? Sounds like you may have a shutter speed that is not in line with your ISO and aperture, so you're not "exposing" the sensor.
