I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. I spent a couple of years representing the government in deportation proceedings, often conducted in Federal prisons. Are there people in the U.S. who should be deported? Absolutely! I have no regrets. But even while serving as an INS Attorney, I fully realized that the man that I deported on Friday afternoon would be back in the U.S., working at his job to feed...

Hi,
I am looking for some advice regarding a seemingly peculiar situation.
my company has filed for my H1B this year alongwith h4 for my wife. My wife is on the verge of getting herself a job. My question is ...since this year's cap hasn't been reached....can she get a h1 visa and if yes how does her already having an application for h4 affect her h1b filing process.

The time spent in H4 does NOT count towards the 6 year H1 time. So in your case the H1 clock starts from Sep 2004.

My wife who is currently working as a doctor in medically underserved area(J1 waiver case), on cap exempt H1B visa. Her clinic is contemplating name change. I will really appreciate if someone can shed the light on how might this proposed name change can/will impact her status?
Her visa is currently unstamped and we are planning to get the same done this year in october. My queries are as follows:
1. Will a new waiver petition and H1B visa need to be filed or only an addendum notification to the USCIS will suffice?
2. If the latter is true then what kind of additional documentation will be needed for visa stamping from the lawyer?
Attorney input will be highly appreciated.

I received my EAD today, but my I-140/I-485 are pending. Is the EAD of any use right now? I think I have to wait for the I-140 to be approved before changing jobs, right?

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I received a Biometric Apt. through my attorney a month back and I appeared for the apt. The time was coincided with my move so it went to attorney and didnt come to my address.
Now I received another notice dated one month later than the first one. So I want to talk to them and findout if it necessary to appear again.

Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

I am trying to look up dates for H1 visa stamping in Canada and the website says no appointments for 6 weeks. I am thinking of going for visa stamping in July. is there any chance that they might open up some more appointments in the next few days even though it says unavailable currently? please post your comments and experiences regarding this.

Guys, My appeal "I290B" for a denied I140 under EB3 category was submitted on March 5th 2008 to TEXAS service center AAO.
I have 2 questions in tracking the application
1) Are all I290B's processed initially where I140 is denied and then later sent to DC office, or completely processed by TSC.
2) If the applications are sent to DC after review by TSC. how long does TSC take to review the application before forwarding to DC and how long will DC require to process the application to close the case (I know total is 14 months for EB3)
