Hi All
Does anyone know answer to my question? GC processing for family based has preferences 1, 2A, 2B, 3, 4 and then employment based has EB1, EB2, EB3 and so on. In what sequence USCIS assigns GC to these categories taking into consideration per country 7% limit? For example, 1 GC to family 1, then 1 to family 2A, then 1 to emp EB1 etc (a hypothetical sequence). Any idea?

Hi,
I filed my I-485 application with vermont and I live in WA, according to the instruction form , I765 should be sent to Nebraska
1. Where should I send the paper filing for EAD ot Nebraska or Vermont.
2. Should I make the check payable to USCIS or Department of Homeland security.
Pls help.

Hi,
I have a valid Visa from Employer A till May 2012. I moved to a new Employer B in Feb 2010 and my H1B was approved till Jan 2013.
I am planning to Visit India in June 2010. Can i come back to US, New Jersey with my Old Employer Visa and New Employer I797.

I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
- Will the immigration officers who did spot check inform USCIS that i was out of status?
- Will case get rejected due to delay in applying for COS?
- Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
- How to stop F2 COS if i get H1 transfer approved first?

I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

You can get reimbursement for all eligible expenses but you will not get the tax benefit. The taxes due on that amount will be accounted for at the time of filing your return. You can submit claims and get them reimbursed.

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. the LCA needs to be done for any H1B or when the job is in a new location. it doesn't take long to get that submitted (<1 day) no need to go stamping. it doesn't cost any money to submit a new LCA

Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.

I am new to this forum and this is my first post. I am not sure if I can even bring this topic up about PERM in this forum. So, if this is irrelavant, please let me know.
My employer will be submitting a PERM application for my L.C. in a day or two. All the requirements for the job are complete. My question is, on the applciation there is question (Q:12) which states about "business necessity" and my employe will be checking "NO" as the answer. I am not sure what impication this could have on my application. The job requirement is B.S. degree with 5 yrs experience. I have a M.S. degree with 5 Yrs experience.
Please let me know if we are going in the right direction.

I came in 2003 on an H4 visa with my parents who were on H1B, I was 17 yrs old at that time. I then got my status changed to an F1 in 2004. I completed my bachelors and have been accepted into a masters program on a scholarship. I wanted to visit India, however I would like to know the risk involved in doing so. Would I still be at risk of not getting a f1 VISA in India even if I carry my approved F1 petition? Please advise..Thanks..

I am July 2nd filer at NSC.
I got my EAD approved from NSC on 25th. I see a message-- card ordered. Today there is one LUD , approval notice sent.
Is this common
