Hello,

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.

I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

I would like to invite my brother to US for a 2 month road trip I am planning in April.

I finished my employment in Jan and currently on 6 months B2 visa. I got my NZ residency approved and I will be leaving US in June at the end of road trip. I have been living in US for past 10 years (3 years on F1 and 6.5 years on H1B). I am 32 unmarried/male/Indian from Hyderabad.

My brother is 33 and is married with a 3 year old daughter. He manages my dads businesses (rental properties, finance, farm etc.). I am pretty sure he has some properties on his name.

I would like to know what are his chances of getting visa approved.

What do I need to provide him as support and what does he need to provide as support documentation ?? What does US consulate look for support typically and to what extent ?

I would really appreciate if anyone can give some advice especially someone who were successfully able to get a US visitor visa to their brother.

Hi,

I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.

Now i wanted to change my status from H1b to F1(CPT). My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?

I would really appreciate your help regarding this issue..

Check the status using the H1B receipt number usually EACXXXXXX or WACXXXXXX

If something has changed, The status gets changed.....kinda weird.

Recently I filed a H1-B Part time Visa. I received the notice from the Lawyer that my application got a RFE on it.

Will they usually show the status online? When I check USCIS, it does not say my case had a RFE on it.

Following are my case details -

Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009

Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009

What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?

Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?

Kindly suggest.
