    Due to the big mess of July visa bulliten. Can I file multiple 485 cases to secure that one of my AOS case is accepted? Since once it is rejected due to improper filing, the next visa bulliten would be back to 2006 or 2005.
    My situation is:

    First I-485 case: I can file I-485 as principle applicant, and my spouse can file as dependent
    plan to submit at the end of this week (Aug 11, 07).

    Sencond I-485 case: My spouse can file as principle applicant based on his I-140, and I can file as dependent, plan to submit before Aug 17, 2007, with cover letter stating:
    If the first AOS case based on xxx's I-140 is accepted, please withdraw the second AOS case based on YYY's I-140.

    Is it doable? any potential issue? Thank you very much for your comments and advise. Urgent!!!

    First of all I am filing by postal mail USPS(not e-filing)

    1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
    2) for AP renewal is it necessary to include marriage certificate for spouse
    3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my AP renewal
    4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address

    IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.


    Any clarification is highly appreciated

    People suggest to work for 6 months...Remember there is no rule to work for 6 months. But just incase if somebody ask at the time of applying for citizenship, you can show that you worked for 6 months.

    I applied for I485 like many others in July. I just heard my group may be spun off from its parent company and might be funded by VCs. Does this mean I cannot use my LC/I140? If/When I get my EAD will it be valid?

    Please help me decide.

    I have Bsc (3yrs) and MCM(3yrs) (MASTER OF COMPUTER MANAGEMENT) from india .
    Degrees evaluation says "UNITED STATES DEGREE EQUIVALENT BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE"

    6 yrs + experience prior to joining the current recruiter.

    Am I eligible for EB2 category, as my employer says, EB2 be most likely would be rejected/denied and its a big risk

    Let me know your inputs.

    I would like to apply for the H1B Visa. For the same, I would like to clarify whether I am eligible with the following education background (Basically I am looking for the 16Yrs education criteria)

    1) Did schooling up to 10th (10 Yrs)
    2) Did Diploma (3 Yrs, Full Time)
    3) Total IT work experience is 9.10 Yrs
    4) Did B.S ( Bachelor of Science -- 3Yrs - Work Integrated Course/Distance Edu)

    Hi,

    I am renewing advance parole (i-131 form) for me and my wife. Can some one answer what the "class of admission" means on the form and how do we fill it?

    I entered the US as H1-B but moved to EAD status last month.
    My wife entered the US on advance parole and is currently working on EAD.

    Class of Admission is the status you were admitted into US. You entered on h1b and your wife on AP and thats the class of admission :)

    I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service.     Your friend's wife should be okay. As long as the marriage took place before his I-485 approval he can add his spouse for an AOS or follow to join application even after the approval(within limited time window, of course).
    In this case the application was sent before the approval so there should be no problem.

    Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

    Not yet....you know they are very lazy to implement it esp. good one's that people are benefited..
