Yes, your assumption is wrong. The dates move when USCIS doesn't approve many cases ina month. That leaves DOS to believe that there are no enough demand and hence they move dates forward. but as I said, I am very positive that the movement is to facilitate CP to approve cases. I wont be surprised if they move EB2 further next month.

So much for unions to support them for mid term elections.. Come next year, if dems still have same majority, H1B/L1B word will be removed from India's IT dictionary..
All they had to do was to introduce another $2000 fee for every Green Card Re-Captured. Most of us would have been out of this mess and they would have got the money they needed. This Grand posturing is extremely disturbing and i hate the politics behind it.

gctest, personally I don't see any issue with eb3 to eb2 porting, look at the porting opportunity from eb3 applicant's point of view, these applicants are waiting since 2001 for GCs but EB2 applicant with PDs 2005 are getting GCs, eb3 to eb2 porting is a way for them to jump ahead of 2006 eb2 filers and get their GCs, I don't see anything wrong with it, sure it causes 2003/04 eb2 filers (very few I guess) to wait a little longer but every law has a loophole and we just have to live with it,
How many eb2 filers are really qualified for eb2 labors? I see lot of consulting firms abusing eb2 labors and lot of people who are playing the game fair are left behind, I feel porting labor is a way to level the playing field, also people who filed eb3 labors in 2001, 2002 are qualified for 2005 eb2 labor anyway, just think these applicants file eb2 labor in 2005, as you said if they are not eligible they will be denied to use the opportunity and its OK if you wait a little longer

I am for it ( without diluting our present progress).
In fact it is the real date which makes sense & also provides relief to all H1-B new or old. New guys can peacefully change their jobs till their PD becomes current & do not get screwed by employers

My case is not yet approved, I Filed on Aug 01 st, Vermont Service Center.
Can you really go for H1 stamping when you are coming back on AP.
As far as I know, you should not use H1 at port of entry while coming back, if you do that your green card will be aboundend. Gurus please currect.

Its stupid to say my wife is not working so she has no business to send money to her parents. Its so wrong and I'm surprised folks can think like this. If the in-laws are any sensible they won't accept gifts from the son-in-law but its for them to decide.And stop receiving any gifts from either sides.

I worked for a MNC here in first few yrs at US (from 2000) and they suck up your Tax return , used to give a worthless health insurance and 'sweat shop' ( this probably a worse word than 'chop shop') like allowance for 12-14 hrs of work . If you do NOT accept that or ASK QUESTION your flight tickets back to origin to will be arranged. I know these practices changed to some extent over a period of time but by that time I left them and started doing things on my own ... :) and i'm very happy since then.
Another thing , I worked for good but medium sized consulting firms with US after leaving those shops ( sweat/chop/body whatever kind u call them) and they do maintain perfect balance - hardly 30-40% is H1B - they pay market salary to the H1B's ,standard health insurance , always got paid if i worked beyond 8-9 hrs ...

I am not supporting this bill in anyway, I hate infy as much as I hate this bill. Remember these companies did not leave any stone unturned, milked the client every possible way and expoilted the employees to the maximum extent. In one another post - VLDRao was saying these companies does the tax filing on behalf the emoloyee, get the refund and again claim that tax in india using double taxation aoivdance treaty.

HR 5882 has the answer for the FIFO problem.
USCIS is pretty good with approving cased based on PD for 3/4th of the year and in the last quarter they for the "Hail mary" play and DOS gives a wide PD range during the last quarter for USCIS to play. Apart from recapturing wasted visa's HR 5882 also has an automatic recapture provision to avoid any future visa wastage. If this provision is in place then UCSIS/DOS will not be in a position to playing the "some how use up visa by sep 31" card to approve random cases.
Rather than focusing on HR 5882 many are still pondering about LUD's and sill day dreaming. The demand for visa's is much higher than the supply of visa's, it doesn't matter what new spillover policy USCIS adopts, it can only provide incremental improvements. For a quantum improvment in the situation we need a legislation and HR 5882 is the best option we have now.

How many pending applications are there?
How many new ones accumulating every year?
Are there enough recaptured visas to cover all?
Agreed that with more visa numbers, and no potential threat to wastage of visa numbers, USCIS has no incentive nor tricky cards to play to justify their random approval bursts.....but will that be enough to prevent them from doing so, just because they can? I mean this is USCIS we are talking about.....Even with laws/memos/rules already in place, they are violating them left and right....
Whats to say that they won't try to reassure people that they don't have to worry about out of order processing because
- there are enough visa numbers for all.
- Though people may see delays, they will eventually all get their GCs
- Its faster and easier if they just grab the first box that is on the top of the pile, and approve cases from there rather than spending very limited resources they have to try to dig thru the boxes to find the cases with oldest PD.
- It will just be a minor inconveneince to the applicants...Their waiting times would drastically reduce from several years to only couple of years.
Would that be acceptable to us then?

I happen to be a freelance writer (not a journalist). In response to this thread, I have penned a 2,700 word commentary on the current challenges titled "The Plight of Promise". In order to beef it up with some compelling statistics, can 5 or 6 people respond to this thread with anonymized details of their specific circumstances and how they are suffering.
