Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

Not sure if increase in immigration fee will make GC processing faster.

Yes, it will definitely make the GC processing faster but only for Agriculture/ illegal workers...we pay they benefit. :D :D :D

Hi guys,
MY H1b extn is due in November. But as my marriage will be in May or June i need to go to india. My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

When she and her husband called me, she thought that she qualified for benefits under CSPA. Initially, I was skeptical. In every seminar regarding the Child Status Protection Act (CSPA) that I have presented on behalf of the American Immigration Lawyers Association (AILA), my mantra has always been, if you marry, you lose whatever benefits you gained under CSPA. Still I listened to what she had to say, and in the end, I agreed with her. She and her husband were both physicians, born in India and trained in the U.S. They both would have qualified for permanent residence in...

My wife's I-539 got approved this month (H4 -> F1). My lawyer said that applying for AOS is not an issue as long as she does not travel outside the country while her AP is pending.

Hi,
I believe someone already asked a similar question but I just want to describe my exact situation:
- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.

Hi Fellow forum users
I and my spouse both have primary/derivative through each other. However I only have EAD (dependent) through my spouse's principal AOS. Can I use that to change my job? I dont have time to apply for a principal EAD. Once I start the new job in dependent EAD can I apply for an EAD based on my primary AOS so that my new employer can drop a AC21 mail to USCIS? The reason I want to do this is to maintain my principal AOS as well.
Thanks in advance for all your comments/insights.
Regards

I did it through an attorney and captured about 5 months.
They did a photo copy of my entry/exit dates in the Passport and copy of all my previous I94 cards. Along with that they sent in a Letter asking USCIS for the recapture.
It was a H1 transfer and recapture at the same time. I got approved for 17 months ( 1 Year + 5months recapture). at that time, I was over 6 years without I140 approved.

Hi,
Firstly, I would like to apologize for my ignorance & starting a new thread on this topic. I have some questions on porting & hopefully you learned people would help me on this.
1. When is the actual PD porting done? Is it done at I-140 stage?
2. I have I-485 filed in EB3-I. Now, I do my labor in EB2 & then at the time of applying I-140 do I tell USCIS that I have an old EB3 with PD of Nov 2004?
3. Say I do that, will USCIS automatically change my category on my pending I-485?
4. When I filed my I-485 in EB3, I was single. Now I am married. If USCIS automatically adjudicates my pending application, I believe, I will be in soup since my wife is not included in that. So should I (or the attorney) tell them NOT to adjust category on my pending I-485 instead I file a new I-485 under EB2?
Thanks

As per latest Faqs from USCIS interim EAD is possible. See below;
http://www.uscis.gov/files/article/2yrEAD_FAQ_061208.pdf
Q) I filed my Form I-765 more than 90 days ago and I have not received a decision, who should I contact?
A) If you have not received a decision within 90 days of the USCIS receipt date and you have properly filed your EAD application, you may apply to obtain an interim EAD by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization.

Those of you who have been reading this blog awhile will recall the many posts I've written regarding major problems in the system of detention for immigrants facing potential deportation. Nina Bernstein of the New York Times reports this morning that the White House will enact a series of reforms designed to curb abuses. Some of the promised changes are vague, but an immediate step will be an end to sending families to the Hutto detention facility in Texas, a location that has been the source of many complaints. The Administration is apparently looking at more alternatives to detention for non-violent...

Hello All,
Below is a link I came across which is easy set up, formatted already for users to input their personal information and off it goes to the Congress to educate them about the importance of travel industry and meetings market. Is their anyway we can come up with something similar and easy to use so our users that do not get on the bandwagon at times just because of the extra work that goes in to it can also contribute?

Hi,
I am working for company A with L1 Visa and this year I got H1 and wanted to continue some more time with L1. I read following information
http://immigrationvoice.org/forum/showthread.php?t=10106
I want to apply COS ammendment and LCA, do I need to file through employer or I can file it individually?
It would be great help if you give more info on COS and LCA.
Thanks in advance.

Hi, this might not be the right forum for my question but at least I am hoping that I can either can an answer or steered to the correct direction. So I quit my job in the US about a month ago because I was immigrating to another country. My job was located in Arizona and I immigrated to Israel. My company knew this was the reason I was quitting. So I am wondering if I should have received a severance package or unemployment benefits because of the reason of immigrating to another country.
Thanks!
Thanks!
