Hi,
I am on H-1B with a company and have been through my 4years of H-1. Now they are saying that they might not be able to apply for my PR before the start of my 6th year of H-1 and are offering me the following option: Need to leave US and go back to India or any other country, will be paid US salary and then after one year will be brought back on a L-1A visa. Now my question is can they pay in US dollars while i am outside US and still be able to come back on L-1A visa? or do i need to change into local payroll?

If the company has 4-5 other accountants then the company should be really large with a separate accounting department or should be an accounting firm. Otherwise the question will arise as to why they need so many accountants working in-house. Should be sufficient if you list all people and provide the educational details, their are also otherways of responding to this RFE and alternative ways of responding to this particual question to show that it is common in the industry to hire people with a bachelors....etc, i would take the help of an attorney if i was in your place.

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

Hi Gurus,
I was wondering if anyone on this site has ever filed an EB2-NIW I-140 petition ? And if so, what fields have you filed it in ? Do you necessarily need a masters degree or would 10+ years of experience in systems development qualify ?
I was also wondering if working in the health-care technology field, to create systems to diagnose and monitor cardiovascular systems to detect/prevent heart diseases would be something that could considered in the "national interest" ? If there is a job offer already extended to someone to work on such projects, would you still need a labor certification ?

H1B would be difficult as that requires 4 year college degree.
But she is eligible for MS depending on requirements of programs, let her research schools and their programs.

I am on US since Apr 2003 on L1B and it expires on Jan 25 2008
Last week my employer applied for L1A and it got approved. Approval notice says the new L1A visa is valid from Jan 26 2008 to Jan 26 2010(2 years)
I am planning to travel to india on vacation at dec 2007 and come back to US on Jan 1 2008
1) If I travel back to US on Jan 1 2008 without stamping L1A on passport, will the port of entry officer give I94 till Jan 26 2010 if I show the approved L1A I797 petition?
2) If I stamp L1A from India, when stamping the new L1A, I assume they will cancel my current L1B and stamp L1A which is valid only from Jan 26 2008. Am I correct? Then I will not be able to travel on Jan 1st 2008 since I dont have a valid visa stamped on passport at that time!

On April 26, 2009 (Sunday), I had a LUD on my current H1. This seemed strange to me. Applied for 485/EAD/AP during July fiasco. My priority date is March, 2006 (EB2-India).
Did anyone who is in similar situation as me have a LUD? Please ignore this post if this has been discussed earlier.

Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?

My employer filed for my H-1B in premium processing, but it got denied because lawyer submitted wrong EIN number.
My questions are:
Will they re-consider my case if lawyer submits the correct EIN number?
How much time will it take to process, if the willing to re-consider the case?

My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

Hi all,
I have posted my case details but here it is again. I got a reject on my H1 after receiving 221(g) form. Same old reason cited in the letter. The case reached USCIS on 28th Jan and no progress after that.
My husband works for the same company and he got his visa stamped after 221(g). Now i am planning to apply for H4. I have a few questions.
1)Can i go for H4 stamping without revoking my earlier H1? Will i be asked to revoke my H1?
2)Since my husband works for the same firm and i got a reject working for the same firm, can my H4 be a problem?
3)Can it be a problem to my husband's H1 who got it stamped successfully and is already in the US?
4)My idea of not revoking H1 is because i want to try a COS once i am in US, which some people have done it successfully. But does anyone know if this has to be done before April, before the new H1B quota opens up?
