Folks,
I have a question about a new H1-B application while I-485 is pending. If I-485 is pending and the person is currently working on EAD with expired H1-B, is there a requirement that the person has to leave the country to apply for a new H1-B based on pending I-485? If yes, will it affect the green card process negatively?
My attorney says that as there was a gap in H1 status, one has to leave the country for a new H1 application, even though it is with the same employer.

This is what, I saw on Ron's forum. We would need to continue what IV has been suggesting since long .....
Can USCIS be sued for picking files in random ( the only time they budge is when a federal judge put an order ).
Ron Gotcher: Anyone can be sued for anything. In the absence of a large, well funded group of plaintiffs, however, I don't see this kind of suit going anywhere. For now, the remedy is Congress. Organize a group to initiate a letter writing campaign to Congress. Write to your own Congressman, your two Senators, and the chairs of the Senate (Kennedy) and House (Loftgren) immigration sub-committees. Get the facts straight and offer as much emprical evidence as possible. If Congress were to receive 100,000 such letters, they would definitely do something about this problem.

Back in 2002, the President signed a law designed to keep immigrant families intact, the Child Status Protection Act (CSPA). I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

For what could become the third year in a row, the Senate on Tuesday evening did not pass an Intelligence Authorization Bill, over the objection of a lone Republican senator whose name is being protected by his colleagues.
John D. Rockefeller IV (D-W.Va.), chairman of the Senate Select Committee on Intelligence, called the delay "one of the more embarrassing efforts I have been associated with in my 24 years in this body." The panel's vice chairman, Sen. Christopher S. Bond (R-Mo.), took the Senate floor Tuesday and called on "any person who has a hold on this bill to come forward and find out what is in the bill."
Rockefeller and Bond have been working over several months to meet objections to items in the bill that the committee passed last May. With changes that Rockefeller and Bond worked out, the measure was reintroduced Jan. 27 and put on the unanimous consent calendar on Feb. 8.
Sen. Jim DeMint (R-S.C.), a member of the Foreign Relations Committee, was named by Congressional Quarterly yesterday as the member who put the bill on hold. A DeMint spokesman said the senator's office "does not comment on holds," but other congressional sources said that DeMint was the one.
Those sources said that they believe the hold is due to White House objections to specific provisions, including public disclosure of the national intelligence budget; a requirement for a report on secret CIA prisons; and response to information requests by the committee chairman and vice chairman within 30 days.
"We have to be able to pass authorization bills if we are to have an impact on the intelligence community," Bond said.

I have to Renew my AP which was expired 2 years back. I work and live in Virginia
and my I-485 is pending at NSC.
At which center should I apply for AP renewal?
Can I e-file for AP?
What is the difference between Paper filigng and e-filing?.
Please help,

I am in my 5th yr of H1, and my H1 status will expire next year on Nov 1, 2011.
My I140 filed and is with the appeal Office since jan 2009, with no decision.
I wanted to know what my options are with the current scenario.
� What are the chances of this appeal being approved? ( it was denied based on 5 yrs of education vs 6 years)
� If the appeal is denied, can I transfer the Labor to an EB3, with the same Priority Date?
� Since there is no decision yet, do I have to file another Labor cert ( a new one) for H1 extension.
� How can I still maintain this priority date?
� If I have to file a new Labor cert, can that be done in EB2,with a different job title?

Hi,
I recently (a couple of months ago) switched firms. I have a valid H-1B visa stamp from my prev employer (expiring in Aug 2009). My H-1B transfer was approved and I have a valid I-797.
Can I travel to London, for a week's vacation and re-enter with my prev employer's h-1b visa stamp and the new I-797? I've read that this is possible and that folks have done it.
I was wondering if there was any change to the rule or anything I should be aware about.

I would like to apply my 9th year H1B transfer with new employer based on my Labor which is pending for more than 365 days with my Current Employer. The proofs which I got from my current Employer are
1. Certified mail receipts showing the date my documents were received by the Labor Department.
2. Fax received on year 2004 from Labor Department which shows list of employees for whom they filed labor via my current company. This contains my name, case number and priority date.
3. Based on this pending Labor I got last year extension with my current employer.
4. Labor documents which they sent DOL.
Would this information be sufficient and helpful to file H1B transfer for me? Or Do you need any other information to do H1B Transfer? If so please let me know In which ways I can get the information other than my Employer. My employer will not cooperate with me in this issue.

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).
