Hello Everyone,
My wife is trying to process visitor Visa for her parents and she has a problem with her mothers name in the Passport as it reads just the short name instead of her Full name.
I'm wondering if the Affidavit would be sufficient while going for Visa or would this still be a problem?
If affidavit is sufficient, can someone please kindly share the sample affidavit if you have one?

My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.

I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

What happens when a person takes a leave of absence and is out of the country? 140 is approved and I 485 is pending? Technically employed but not getting paid. My cousin is considering this as a possibility and is being overwhelmed with responsibilities in India. He was a July 07 filer, and his pd is Apr 02

We are getting ready to file for another H1B extension, and based on work location, will have to file with the Vermont Service Center. The employer is NOT cap-exempt, but I have had an H1B for many years (so do not need to file for new visa). I am not sure which is the correct address for filing, though. (See p. 20, I-129 instructions.) I think we need to use:
All other I-129 Cases:
USCIS
Vermont Service Center
ATTN: I-129
75 Lower Welden Street
St. Albans, VT 05479-0001.
(Other option:
H-1B Cap Cases:

Once we receive EAD and all 9 yards notices and once you switch from H1 to EAD system with same employer, are you still bound to work with same employer for full 40 hours.. can you cut your hours to 20 hours (nooo second job too). I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 4 weeks ago and it was received by them the next day(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

My wife came to USA on H4 visa in January 2004. Later when she got a job, she changed that to H1B in September 2004. Since we do not yet have the EAD or green card, her company is now filing the Perm labor certifcation, to make sure that she gets the 7th year extension of H1B. The rule is that you should file the labor before the 6th year starts.
My question is when does her 5th year ends. Was it on January 2009 based on her arrival in USA or is it on Sepetember 2009 sincw her H1B visa started only on Septemeber 2004?

I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?
