Hi All,
I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me

Yes, as long as you have valid AP, you can re-enter and resume working on a valid EAD.

Hi everyone:
I'm new at this forum and am hoping someone would be able to shed some light on my dilemma. My labor certification is currently under supervised recruitment. I checked the America's Job Bank website and found my ad, but the job description in it contained only the part according to O*Net occupation description. The form ETA-750 had some additional job requirements posted by the employer, which were omitted in the AJB ad. I'm afraid with the current ad at AJB they'll get tons of applications.
Can someone advice what shall I do?

I am planning to go for visa stamping soon. This will be by 7th year extension. I have the following questions. Thanks for reading my post and for replies.
1) Recently my title changed from "member of technical staff" to "senior member of technical staff" and I got a pay increase. But the job duties is the same. I don't think this needs H1 amendment. Does it ? I also hope that this will not affect the green card processing.
2) This may be a dumb question. I have the approved I-797 but the online status still shows as pending. Since I know at least one USCIS database is not updated, is there a reason to suspect PIMS delay when I go for stamping ? I am planing to go for stamping in Chennai, I assume there is no way to check beforehand. Did anyone else experience the same (online status not updated) and face any delays due to PIMS.

Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

Hi, we gat our GCs in aug 2008. My husband works for a Swiss bank in US. They are offering a promotion and move to Europe. If he accepts how will it affect our GC and eligibility for Citizenship in the future.

Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.

I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.
I have 2 questions here.
1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.
2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).
Please advice, I will really appreciate your suggestions on this ASAP.

The expiry date of B1/B2 is printed on the visa. Getting F1 does not invalidate B1/B2. Unless the visa issuer put a stamp on the B1/B2 as "Cancelled", it is still valid!

I am trying to look up dates for H1 visa stamping in Canada and the website says no appointments for 6 weeks. I am thinking of going for visa stamping in July. is there any chance that they might open up some more appointments in the next few days even though it says unavailable currently? please post your comments and experiences regarding this.

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. I hyphenated my name while I was applying for a green card. All of my Canadian documents like my passport and my Canadian photo ids like my Ontario drivers license and health card are all in my maiden name. Can I bring my green card alone with no other documents or do I need some other government issued id? The only thing that has my current name is my green card. What do I need to get a license.
