Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

Is it ok to transfer H1b to different employer after using AP? I resumed work with same employer on H1b after entering with AP recently.
My H1b is valid till 2010 . H1b was last exteneded an year back, inside USA, before I left to India.
I am going to get info from lawyer, but I wanted to be sure..

thats means its not approved. u cant file for i140 without labor approval..hence cannot file 485 also.

I filed the i-140 last October, and didn't hear anything until May 2007 when i received an intent to deny. After speaking to the attorney he put the wrong name on the application! He fixed that then forgot to send the check!
So we refiled a new I-140 again PP, and referenced the labor certificate in the old case that we appealed.
They looked at the new case, and put in a request to get the original labor cert from the old case, which took about two months.
I received approval yesterday.

As most of you know we formed a focus group to work on the 'Country Cap issue'.
We have a letter ready to be sent out the the lawmakers to lift the Cap - may be temporarily- I would request you guys to spend 5 minutes and 42 cents and send it out to your senators and congressmen/Congresswomen�.If 50 people from California can send this letter to 'Congresswoman Zoe Logfren', I'm sure it will some some difference...

Please correct me if i am wrong.
WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.
But not sure if your h1 still have time, after DOL complain, you can transfer it or not??
Anyone has any idea???

Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...

My online case status changed to the following information "On April 22, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283". I am applying for my family and I but my 3 year old sons update is RFE??? I havent received the letter yet but I was wondering if anyone else found themselves in this situation and if so what was the outcome?

HI,
I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

It will not be "a problem"; but they will stamp your passport only till the exp date of passport (March 2011) and your I 94 (that you will get upon returning) will also be valid till March 2011 as well.
