Here's a guy with class. Criticism welcome, just nicely put please. Didn't have time to hand draw the font I wanted, but it's something.
Thanks! Best of luck to all.

With a newborn at home, this was a crucial decision for me, if I used EAD (with same employer) I could work minimum hours like 10-20 hours a week. I just wanted to be sure that at the time of GC processing, my less hours worked shd not be taken as an objection.
Thanks again :)
Thanks again :)

All too often, it seems that some examiners at USCIS Service Centers are just looking for a way to deny petitions. Long-standing policies are ignored and new theories are advanced to deny perfectly-qualified applicants for immigration benefits. A few months ago, a few examiners decided on their own that M.B.B.S. degrees which are issued to physicians from British Commonwealth countries were not equivalent to M.D. degrees issued by medical schools in the U.S. As a result, many petitions and applications were denied on this basis. After much protest from the medical community, the USCIS in Washington got involved, and the...

I guess you can, provided you gain the specialized knowledge during that duration (6 - 7 months) which you currently lack to get the approval.

Once you start working as a trainer, you have violated H-1B status so that you must rely on the EAD for both the gym job and the Systems Analyst position. You must also use Advance Parole, not the H-1B visa, to return after travel.

Hello,
I have an "intend to deny" on my GC as EB1 that I got by applying myself as primary and wife as secondary. wife is on h1b and me on h4.we got EADs and if the GC is denied, we will lose the EAD.
I want to incorporate for several reasons hence i will be using the EAD for that.
using EAD invalidates H4 ? but H4 is automatic status based on H1b .
My wife did not apply for GC as primary and me on secondary but we intend to that in 3 years when it becomes current as EB3.

Folks,
I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,
LT

Quote from Anna35 ():
" I live less than a mile of Lincoln Nebraska Service center, and the parking lot was full yesterday saturday from 7 to 12 pm after that and today sunday is empty. so dont work beside the system automatic updates... "
NSC must have used up all the FY2007 visas...if not and they did not work on the last day of FY2007, then we can conclude that they really don't care if visas are wasted or not.
Do not expect any approval from NSC today....we can only expect automatic uptdates!

Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.
Thanks,
RK

If you call USCIS 1800 number, and you ask the representative to raise a service request then they email the service center asking for details. Most of the time, personnel from service center will call back with the information that you have requested. If you learn there is a way you can email the service center, please post here.

The GOOD: (1) H-1B visa numbers are still available! USCIS recently advised that, as of September 3, 2010, approximately 36,600 H-1B cap-subject petitions were receipted. Additionally, USCIS has reported receipting 13,400 H-1B petitions for aliens with advanced degrees. Therefore, more than 35,000 new H-1B visas are still available for fiscal year 2011 (which ends September 30, 2011). Given the current usage and demand, it is anticipated that the H-1B cap will be reached sometime in the first quarter of 2011 (with no new visa numbers available until October 1, 2011). (2) China Reciprocity schedule amendment! Effective July 9, 2010, the...
